MLS RULE R-345 FOR LISTINGS (BROKER LOADS) *URGENT* 2008-05-28
The following amendment to MLS Rule R-345 has been approved
by the Board of Directors and will become effective May 12, 2008:
R-345
MLS Listings appearing on the MLS System shall be
immediately available (subject to applicable legislation, the rights
of and reasonable accommodation to the occupancy) for
showings, inspections and registration of Offers.
In the event an existing listing becomes unavailable for showings,
inspections or registration of Offers, the listing shall be
suspended.
While under suspension a record of all requests by Co-operating
Brokerages for showings, inspections and registration of Offers
shall be kept by the Listing Brokerage.
Upon the Seller rescinding the suspension, the Listing Brokerage
shall immediately notify all Co-operating Brokerages who have
requested showings, inspections or registration of Offers.
The revision of MLS Rule R-345 is necessary to assist with
communication amongst Members. This rule states that when
placed on the MLS System, the property must be available for
inspections, showings and registration of Offers, therefore if a Cooperating
Salesperson is calling to make an appointment to show,
inspect or register an Offer he/she may not be able to show
because of illness etc., but at least the Listing Salesperson and Cooperating
Salesperson have communicated, then if showings
change, the Listing Salesperson can contact the Co-operating
Salesperson and inform him/her of the change.

Further, the bracketed portion relates to any legislation that may
restrict showings, etc., such as the Residential Tenancies Act, 2006
where it requires that proper notice must be given to the Tenants.
With the implementation of above-noted MLS Rule R-345, current
MLS Rule R-350 regarding ”°No Showings”± will be eliminated as
much of this rule has been incorporated into the revised MLS Rule
R-345.
